MEDIACAMP GENERAL TERMS AND CONDITIONS OF SALE

Article 1 - Application

These general terms and conditions of sale apply to all orders placed with Mediacamp by a client and are the only terms binding the parties.

Mediacamp performs its services notably through the website Toocamp.com

Each transaction is subject to a specific contract between the client and Mediacamp which defines its content.

Article 2 – Orders

2-1 : Order

Any reservation must be formalized by a dated and signed insertion order explicitly accepting Mediacamp's general terms and conditions of sale. The document must indicate:

  • the name of the client to whom the invoice must be addressed,
  • the campaigns ordered with the associated rates

2-2 : Insertion

Collection of information related to the client's products by Mediacamp

The client authorizes Mediacamp to retrieve availability information, pricing and descriptive information (texts & images) published on its website and to publish them on www.toocamp.com and on its partners' websites.

Mediacamp is not responsible for the validity and/or updating of this content, as it is the client's responsibility to ensure its accuracy. Toocamp only publishes the information provided by the client.

Article 3 – Pricing / Budget / Invoicing

3-1 : Pricing

Prices apply to various advertising insertion formats (hyperlinks, buttons…) that comply with the format defined by the publisher of the selected websites. They include the possibility of creating a link to the client's website.

Prices do not include the production costs of any advertising materials.

3.2. Subscription to a standard pay-per-click campaign

If the client subscribes to a pay-per-click offer, delivered clicks will be invoiced monthly at the end of the month.

If the client requests a capping limit, invoicing will not exceed the subscribed cap.

3.3 Subscription to a click package

The client agrees to pay for the click package before the activation of the offers.

The client may check the remaining clicks in their account by viewing the statistical report in their interface and request a top-up or switch to monthly consumption so that the campaign is not interrupted due to lack of clicks.

Mediacamp will then issue an invoice in the case of purchasing a new package. Unused clicks will automatically be carried over from one year to the next.

3.4 Invoicing

Media placements and click packages are invoiced upon order.

Pay-per-click services are invoiced monthly based on the click count recorded by Mediacamp.

Social media services are invoiced as follows: 50% upon order, 50% at the end of the campaign.

Article 4 – Compensation Models

Pay-per-click compensation:

Mediacamp is remunerated based on the delivery of clicks to its clients' websites. Toocamp is solely responsible for counting the clicks generated toward its clients' websites.

The client will be informed of delivered clicks through a statistical report available online in the client area provided by Toocamp.

Article 5 - Payment Terms

Upon receipt of the insertion order, the client's products will be put online or will continue to be published. The signed insertion order constitutes a binding commitment between the client and Mediacamp.

Invoices are payable within 30 days by bank transfer.

If the order is placed through an intermediary, the invoice may be issued in their name. However, Mediacamp reserves the right to invoice the advertiser directly, deducting the professional discount, in the event of non-payment.

In case of non-payment of a due amount, Mediacamp may pause the Client's campaign until payment has been settled.

Article 6 – Campaign Postponement

In the event of incomplete traffic delivery, Mediacamp may carry over the remaining ordered but undelivered visits to a future campaign.

Article 7 – Disputes

These general terms and conditions of sale, as well as any acts resulting from them, are governed by French law.
